Right to Work checks are one of the most important parts of sponsor compliance, but they are also one of the easiest areas to get wrong. A small process mistake can become a bigger compliance issue if it leads to missing records, letting someone work without the right permission, or failing to review an expiring status on time.


For sponsor licence holders, the problem is usually not just the check itself. It is the lack of a reliable process around who checks, what gets copied, when follow-up is due, and where the evidence is stored.


1. Not checking before employment starts


You must check a worker’s right to work before they start employment in the UK, and if the person has time-limited permission, you need to check again when that permission expires. If this step is skipped or delayed, the business can lose the protection that a compliant check would normally provide.



2. Accepting the wrong documents


Employers need to check the correct documents or use the correct online route where appropriate. For example, the Home Office guidance explains that biometric residence cards or permits can no longer be accepted as physical proof in the old way, and online share codes are now part of the standard process for many workers.


3. Not checking the documents properly


It is not enough to simply glance at a passport or ID. Employers must confirm that the documents are genuine, unchanged, belong to the person, and match across details such as name, date of birth, and photograph.


4. Forgetting follow-up checks


If a worker has time-limited permission to work, the employer must carry out a follow-up check before that permission expires. Missing that renewal point can mean someone continues working without valid permission, which is a serious compliance failure.


5. Failing to keep evidence


The Home Office expects employers to keep copies or records of right to work checks during employment and for two years after employment ends. If records are missing or incomplete, it becomes much harder to prove that the business did the check correctly.


6. Not using the Home Office verification route when needed


If a worker cannot show the right documents or online immigration status, the employer may need to ask the Home Office to confirm the position and keep the Positive Verification Notice. Skipping that step can leave the business exposed if the worker’s status is not clear.


7. Treating RTW as a one-off task


Right to Work is not just a hiring step. It needs a system that links checks, expiry dates, evidence, reminders, and follow-up responsibility, because weak processes and poor record keeping are common reasons compliance fails.
